Terms of Service
These terms govern your use of Peaksflare — the adaptive AI coaching service for endurance athletes. Please read them carefully. By creating an account or joining the waitlist, you agree to everything below.
Plain-language summary
Peaksflare gives you AI-generated training guidance based on your data. It is not medical advice, it can be wrong, and you are responsible for training safely. Your data stays yours. This is a placeholder template — have it reviewed by a qualified lawyer before launch.
01Acceptance of terms
By accessing or using Peaksflare (the "Service"), creating an account, or joining the waitlist, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to accept these terms for it.
02The service
Peaksflare is a software coaching engine that ingests athlete data — including sleep, heart-rate variability (HRV), resting heart rate, and training load — and generates adaptive training recommendations for cycling, running and swimming. Recommendations are produced algorithmically and adjust based on the signals available to the Service.
The Service is a tool to inform your training decisions. It does not replace professional medical, physiotherapy, or in-person coaching judgement.
03Your account
- You must be at least 16 years old (or the age of digital consent in your country) to use Peaksflare.
- You are responsible for keeping your login credentials secure and for all activity under your account.
- You agree to provide accurate information and to keep it up to date.
- Notify us promptly of any unauthorised use of your account.
04Health & safety notice
Peaksflare does not provide medical advice. Endurance training carries inherent physical risk. The Service's recommendations are estimates generated from device data and may be incomplete or inaccurate.
- Consult a physician before beginning or significantly changing any training programme, especially if you have a medical condition or symptoms.
- Stop exercising and seek medical attention if you experience chest pain, dizziness, or other warning signs.
- You are solely responsible for deciding whether to follow any recommendation, and for training within your own limits.
05Your data & connected devices
To work, Peaksflare connects to third-party services and devices you authorise — for example Strava, Intervals.icu, and Apple Health — and lets you upload your activity files (.fit) directly. You grant us permission to read the relevant fitness and health metrics from those sources solely to deliver the Service. Supported integrations are being expanded during the beta.
How we collect, use, store and protect that information is described in our Privacy Policy. You retain ownership of your data and may export or delete it at any time.
06Acceptable use
You agree not to:
- Reverse-engineer, scrape, or attempt to extract the underlying models or source code.
- Resell, sublicense, or commercially exploit the Service without our written permission.
- Upload data you do not have the right to share, or impersonate another athlete.
- Interfere with, overload, or attempt to gain unauthorised access to the Service or its infrastructure.
07Beta & availability
Peaksflare is currently offered as a private beta. Beta features are provided "as is", may change or be removed, and may contain errors. We may limit, suspend, or discontinue any part of the Service at any time. We aim for high availability but do not guarantee uninterrupted access.
08Billing & plans
Peaksflare is free during the beta period. When paid plans are introduced, pricing, billing cycles and renewal terms will be presented before you subscribe, and you may cancel in line with the plan terms in effect at that time. We will give reasonable notice before any change that affects an active subscription.
09Intellectual property
The Service, including its software, models, design, and branding, is owned by Peaksflare and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your personal training. Your data and content remain yours; you grant us only the licence needed to operate and improve the Service.
10Disclaimers & limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, Peaksflare is not liable for any indirect, incidental, or consequential damages, or for any injury, loss, or damage arising from your training decisions or your use of the Service.
11Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these terms or use the Service in a way that risks harm to you, others, or the Service. On termination, the rights granted to you end, and we will handle your data in line with the Privacy Policy.
12Changes & contact
We may update these terms as the Service evolves. If we make material changes, we will notify you through the app or by email before they take effect. Continued use after changes take effect means you accept the updated terms.
